As used in this document, the term "AQUAPOOLSTORE.COM" refers to the web site owned and operated by Aqua Swimming Pool Supplies LLC; whose home page resides on the Internet at http://www.aquapoolstore.com.

The following terms and conditions apply to our online store operation only, our store policy is difference and orders processed online will be shipped to you and may not be picked-up at our retail location. Our store pricing is different from our online pricing for reasons related to advertising, merchandising, and handling.

TERMS of SALE

(A) - ORDER PROCESSING

All orders are processed on first-come-first-serve basis, order normally ship within 2 business days of the receipt of the order, if merchandise is out-of-stock, or If there is a logistics problem in shipping a merchandise, customers will be notified by email or telephone and given a choice to accept additional charges, select alternative delivery method or cancel the order. We reserve the right to cancel any order that we deem necessary, and may require additional information from you before accepting or processing any order. If your order is canceled, you will not be billed

(B) - REFUNDS AND RETURN

All sales are final, returns and exchanges are limited to:

I. You were sent merchandise other than the one you ordered. Merchandise part numbers as listed on your invoice can be used to verify the item(s) you purchased.

II. The merchandise sent to you was damaged by carrier and you at the time of delivery indicated the damage to the delivery person(s) and noted damage on delivery receipt, or refused delivery. If merchandise was left at your door and it was damaged or lost and no individual at the delivery address signed for the delivery, you must contact us and/or the carrier within two business days of receipt/loss of the merchandise and file a damage/loss claim.

JURISDICTION

Aqua Swimming Pool Supplies LLC is a California Limited Liability (LLC) corporation and you agree that any legal action brought against Aqua Swimming Pool Supplies LLC shall be governed by the laws of the state of California, without regard to its conflict of law principles. And you agree all disagreements arising from orders placed through AQUAPOOLSTORE.COM will be handled in the county of Los Angeles, California by an appropriate federal or state court.

(C) - PAYMENT METHODS

You may pay by credit card no matter which ordering method you use (Internet or phone). At the time your order is placed, Aqua Swimming Pool Supplies obtains a pre-approval from the credit card company for the amount of the order. Credit card billing occurs when your order ships.

We accept Visa, Master Card, American Express, and Discover cards.

You can also pay by check, however we will not ship your merchandise until your check clears, this can take anywhere from 7 to 10 business days. We do not accept check payments from outside the USA.

PLEASE NOTE:
- We require credit card authorization form to be completed, signed and faxed with copy of your driver's license for orders placed with credit cards issued by banks outside of the United States.
- Debit cards and check cards have daily spending limits that may substantially delay the processing of your order.

(D) - PRIVACY POLICY

In order to process your order, Aqua Swimming Pool Supplies requires the following information which is used solely to communicate with our customers and process the order.

- Business / Personal Name
- Full Name as it appears on your credit card
- Billing Address of the credit card
- Shipping Address if different than the Billing Address
- If your billing address is a Post Office Box #, please provide a street address. We not ship to a P O Box.
- Phone Number where you can be reached during the day
- Email address (if you have one)
- Credit Card Number, Expiration Date

(E) - ONLINE SERVICE AND SYSTEM OUTAGES AND PRICING ERRORS

Occasionally we experience a system outage that interrupts our online payment processing services. We ask our customers to make note of all incomplete transactions or transactions that were aborted or experienced a system error and call our toll free sales line 888 298-6165.

We put all our effort to make our web site accurate and error-free, however due to the volume of information we have on our web site and the rate that information has to be updated or changed, some of the information may be incorrect, out-of-date or wrong. We ask our customers to contact us regarding any discrepancies and errors on our web site and we'll promptly address the issue. If a sale was made based on incorrect price or information, we'll contact our customers immediately (within 24 hours) and inform him/her of the error and offer to cancel the order or make arrangement to reprocess the order with the correct price or information.

(F) - RESPONSIBILITY FOR SUITABILITY OF ITEMS FOR A PROJECT

Aqua Swimming Pool Supplies makes no guarantee that the items you're buying are the most suitable ones for the project being undertaken. The customer is responsible for making sure that items are compatible with the needs of their pool/spa projects and should consult with pool professional to make sure equipment or part being purchased through us are suitable. We provide no guarantee of compatibility or suitability of equipment for specific project. Aqua Swimming Pool Supplies does not offer installation and repair service, contact your local pool professional for installation and service related needs.
